These Terms and Conditions (“Terms”, “Terms and Conditions”) govern your relationship with Elite Disposal Services (“we”, “us”, “our”), the provider of junk removal and dumpster bin rental services, accessible via our website https://elitedisposalservices.com (the “Service”).

Please read these Terms and Conditions carefully before using our services.

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and customers who access or use our services.

By accessing or using the Service, you agree to be bound by these Terms and accept all legal consequences. If you do not agree to these Terms, in whole or in part, please refrain from using our services.

Intellectual Property

The Service may contain links to third-party websites or services that are not owned or controlled by Elite Disposal Services.

Elite Disposal Services has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Elite Disposal Services shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through these third-party websites or services.

We strongly advise you to review the terms and conditions and privacy policies of any third-party websites or services you visit.

Limitation of Liability

Elite Disposal Services, its directors, employees, partners, agents, suppliers, or affiliates, shall not be liable for any loss or damage, whether direct or indirect, incidental, special, consequential, or punitive, including but not limited to economic loss, damage to electronic media or data, goodwill, or other intangible losses, resulting from:

(i) your access to or use of the Service;
(ii) your inability to access or use the Service;
(iii) any conduct or content of any third party related to the Service;
(iv) any content obtained from or through the Service; and
(v) the unauthorized access to, use of, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal claim, whether or not Elite Disposal Services has been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed in its essential purpose.

Exclusions

As set out above, some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you. Additionally, provincial laws of Canada may apply to certain products and services provided by Elite Disposal Services.

Governing Law

These Terms shall be governed by, and interpreted and enforced in accordance with, the laws of the Province of Ontario and the laws of Canada, as applicable.

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms will remain in full force and effect. These Terms constitute the entire agreement between you and Elite Disposal Services regarding our Service, and supersede and replace any prior agreements, whether oral or written, regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is deemed material, we will make reasonable efforts to provide at least 30 days’ notice before the new terms take effect. The determination of what constitutes a material change will be at our sole discretion.

By continuing to access or use our Service after the revisions become effective, you agree to be bound by the updated terms. If you do not agree with the new terms, in whole or in part, please discontinue using the website and the Service.


1. Rental Period & Service Fees

Standard Rental Period:
The standard rental period for all bins (10, 14, 20, 30, and 40 yards) is 7 days. If the bin is required for a longer period, an additional $25 per day will be charged for each day over the initial rental period.

Additional Terms:
Bins returned early or under the included weight are not eligible for refunds. Exceeding weight or disposing of unapproved materials will result in additional fees based on the bin’s contents.


2. Payment Terms and Conditions

  • Payment Due Upon Booking:
    All bin rental services require full payment as a deposit to confirm the booking. A payment method must also be saved on file to cover potential weight overages or breaches of the terms of service outlined below.
  • Outstanding Balances:
    If an invoice remains unpaid for 60 days, it will be sent to an outside collection agency. After this point, Elite Disposal Services will no longer be able to assist in resolving the transaction.
  • Cash Payments:
    We may accept cash payments upon special request, but a card must still be saved on file with a refundable deposit for the full amount of the bin rental. This deposit will be refunded once the service is completed, waste is properly sorted, and no weight overages or breaches of the terms of service occur. Otherwise, the deposit will be credited toward any outstanding balances if additional charges are incurred.

3. Property Liability

Elite Disposal Services takes all reasonable precautions when performing services, including dumpster bin rentals and junk removal. However, we are not liable for any damage to property, whether inside or outside, including but not limited to houses, garages, fences, driveways, landscaping, flooring, walls, or other structures. Additionally, we are not responsible for damage to items or objects on the property during the provision of our services.

Customers are responsible for ensuring clear and safe access to the service area and for removing any items or obstacles that could be damaged or interfere with the delivery, placement, or removal of bins, or with junk removal services.


4. Damage Waiver

Drivers and service teams will make every effort to accommodate customer requests for bin placement or junk removal item handling. However, if the driver or service team determines there is a risk of property damage from the requested placement or handling, the service team may proceed only under the understanding that Elite Disposal Services is not liable for any resulting damage.

Additionally, Elite Disposal Services is not responsible for any materials or substances placed in the bin, or handled during junk removal, that may leak, spill, or stain property (e.g., driveways, floors, walls, or landscaping).


5. Live Load

A live load is defined as a 30-minute or less appointment to load the disposal bin. Our drivers are unable to assist with disposing of items; they are there to wait for the bin to be filled. If the driver is on-site for longer than 30 minutes, an additional charge of $2 per minute will apply.


6. Bin Size Recommendations

Based on information provided, we can only recommend a bin size. There is no guarantee that the recommended bin size will be the exact size required for your job. It is your responsibility to order the bin size that best suits your needs. If needed, we can provide additional resources to help determine the correct bin size.


7. Damages to Bin

If any damage occurs to the bin while on your property or job site, please notify us immediately. The bin must remain in the same location as it was originally placed. Relocating the bin by anyone other than Elite Disposal Services staff is prohibited. If damage occurs due to the failure to follow these terms, repair charges may apply.


8. Weight Calculation & Overages

  • Weight Calculation:
    Industry standard: 1000 kg = 1 Tonne
  • Weight Overages:
    If the bin exceeds the weight included in the original rental, the customer will be automatically charged the prorated amount based on the additional weight. Customers will be contacted if the charge exceeds $200. Invoices for weight overages will be emailed, and a weight slip can be provided upon request.
  • Overweight and Illegal Loads:
    Dirt, asphalt, bricks, or concrete cannot be disposed of in mixed garbage bins. If these materials are found, the customer will incur additional fees and may require a new bin for proper disposal. The maximum weight for any bin is 4 Tonnes.

9. Cancellation & Rescheduling

Cancellation Policy/Fee:
A 24-hour notice is required for cancellations to avoid any cancellation fees. A cancellation is defined as any situation that prevents the scheduled service from being completed. This includes, but is not limited to, the designated contact being unavailable upon delivery/arrival, or failing to respond to calls, emails, or other forms of communication.

  • If a scheduled service is cancelled or rescheduled on the same day, a fee of $89.99 will apply.
  • If a scheduled service is cancelled while en route or on-site, a $129.99 service fee will apply.
  • If a scheduled service pickup is cancelled because the load is too heavy or deemed unsafe, a $129.99 fee will apply. Our team will reschedule the pickup, giving the client the option to adjust their waste to meet the requirements or request a second bin and sorting services for an additional cost.
  • If a scheduled service is cancelled due to a blocked drop-off location, an $89.99 fee will apply.
  • If a scheduled service pickup is canceled on the day of pickup due to a rental extension request, a cancellation fee of $49.99 will apply.

We reserve the right to cancel or reschedule any dumpster bin rental at our discretion, including during the scheduled service period, due to unforeseen circumstances or safety concerns.


10. Hazardous Waste Disposal

We can accept hazardous materials for disposal; however, these items must be specifically requested as part of a separate bin rental or junk removal service. This request must be made in advance, and additional fees may apply for hazardous waste disposal. Hazardous materials include, but are not limited to, chemicals, paints, solvents, oils, batteries, asbestos, propane tanks, and other regulated or dangerous substances.

The customer is responsible for ensuring all hazardous materials are properly identified, segregated, and disclosed to Elite Disposal Services prior to service. Failure to do so may result in additional charges or refusal of service.


11. Contractor/Client Conflict

Confidentiality & Conflict Resolution:
Confidentiality must be maintained at all times between Elite Disposal Services and our customers. At no point will Elite Disposal Services become involved in any contractor-client conflicts. If you are ordering a bin to a location you do not own, it is your responsibility to ensure the appropriate permission has been granted before the bin is delivered.


12. Marketing Consent

By inquiring about our services or doing business with us, you agree to allow Elite Disposal Services to utilize any photos, descriptions, reviews, quotes, texts, or videos of the property for marketing purposes. You also consent to receiving notifications or promotional messages via email or text about our services or promotions.


13. Winter Policy

Winter Conditions:
During the winter months, customers must have their driveway and/or pathway clear of snow and ice, and the area must be well salted, including around the bin, to ensure successful drop-off and pickup. If the bin pickup or drop-off is delayed due to snow or ice, a service fee of $49.99 will be applied.


14. Garbage Compression

Third-Party Compression:
Customers are not allowed to use third-party garbage compressors (crunchers) inside our disposal bins. Such use will cause damage to the bin, and the customer will be held financially responsible for repairs. If you require this service, please contact our office at 416-672-0254 to discuss acceptable alternatives.


15. Reinvoicing

Reinvoicing for Mixed Debris:
If a bin has been sold as a single debris flat rate (e.g., demolition debris or concrete bin) and multiple types of debris are found, Elite Disposal Services reserves the right to re-invoice the customer at the mixed garbage bin rate. Please ensure your invoice reflects what was agreed upon at the time of booking. Contact us if you find discrepancies.


16. General Inquiries

For all disposal bin needs, please contact our office at 416-672-0254. Do not contact drivers directly, as they do not have access to the necessary systems for scheduling or changing orders.


17. Voicemails/Emails

Response Time:
All voicemails and emails will be responded to within 24-48 business hours. For immediate assistance, please contact our office. After hours, you can utilize our self-service checkout, quote request, and bin pickup scheduler on our website at www.elitedisposalservices.com.


18. Customer Information

Accurate Information:
It is the customer’s responsibility to provide accurate contact information and delivery details. If incorrect details affect the success of delivery, a $69.99 fee will apply to correct the error. If the error cannot be fixed (e.g., delivery outside the service area), a cancellation fee may apply.


19. Radiation Fee

Radiation Scan:
Each time a disposal bin is taken to a transfer station, it will be scanned for radiation. If radiation is detected, the customer is responsible for covering the radiation fees, which can range from $165-$200. This is required to ensure radioactive materials are disposed of correctly and safely.


20. Asbestos Disposal

  • Elite Disposal Services follows strict protocols when handling asbestos-containing materials. The responsibility for properly removing asbestos and preparing it for transportation falls to a certified Asbestos Abatement team, in full compliance with Ministry of Environment regulations.
  • Please note that our drivers are not permitted to handle asbestos directly. When preparing your bin for pickup, ensure that the asbestos is securely double-bagged and the liner or lid is tightly sealed. If any damage occurs to the bin liner during disposal, please contact us immediately at 416-877-9515.
  • Before scheduling a pickup, we will require a photo of the bin to confirm that the materials are properly contained. This step ensures safe and compliant disposal.

21. Prohibited Materials and Usage Policy

The following materials are strictly prohibited from being placed in the dumpster bin: propane tanks and cylinders, ammunition, leftover paint, paint cans, paint thinner, stains, varnish, household cleaning products, batteries, fluorescent light bulbs, tires, motor oil, gasoline, antifreeze, aerosol cans, pesticides, fertilizers, pharmaceuticals, biomedical waste, chemicals, or any other hazardous waste.

If such materials are visible to the driver at pick-up, the bin will not be collected, and additional fees will apply accordingly. If these items are discovered later at the transfer station, additional charges will also be incurred. Furthermore, the dumpster bin cannot contain mixed materials, such as concrete or other heavy debris, in a bin designated for general garbage. Failure to comply with these policies may result in refusal of service and additional costs.
